SRC-ARR S.B. 1088 76(R) BILL ANALYSIS Senate Research Center S.B. 1088 By: Duncan Higher Education 4/9/1999 As Filed DIGEST Currently, Texas Tech University and the Texas Tech University Health Science Center operate under one board of regents with same chancellor, a president over each institution, and meet the definition of a system in the Texas Education Code. However, the Education Code does not specify that the institution is part of a system. S.B. 1088 would create the Texas Tech University System. PURPOSE As proposed, S.B. 1088 creates the Texas Tech University System. RULEMAKING AUTHORITY Rulemaking authority is granted to the board of regents of the Texas Tech University System in SECTION 2 (Section 109.001(c), Education Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends the chapter heading to Chapter 109, Education Code, as follows: CHAPTER 109. New heading: TEXAS TECH UNIVERSITY SYSTEM SECTION 2. Amends Chapter 109A, Education Code, by adding Section 109.001, as follows: Sec. 109.001. TEXAS TECH UNIVERSITY SYSTEM. Creates he Texas Tech University System (system) to be composed of all institutions and entities presently under the governance, control, jurisdiction, and management of the board of regents of the Texas Tech University (board). Requires the system to be composed of such institutions and entities as from time to time may be assigned by specific legislative act to the governance, control, jurisdiction, and management of the system. Provides that the governance, control, jurisdiction, organization, and management of the system is vested in the board which will be known and designated as the Board of Regents of the Texas Tech University System. Authorizes the board, by rule, to delegate a power or duty of the board to an officer, employee, or other agent of the board. SECTION 3. Emergency clause. Effective date: upon passage.
