DIGEST 

Current state law does not provide a penalty for a person who assaults a
sports official based on the performance of the official's duties.  S.B.
1123 would create an offense for a person who causes bodily injury to a
sports official, or who threatens or causes physical contact to a sports
official. 
         
PURPOSE

As proposed, S.B. 1123 creates offenses to punish assaults committed
against certain sports officials. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Sections 22.01(b), (c), and (e), Penal Code, to
establish that an offense under Subsection (a)(1) is a Class A misdemeanor,
except the offense is a state jail felony if it is shown at trial of the
offense that the offense is committed against a sports official in
retaliation for the official's duties.  Establishes that an offense under
Subsection (a)(2) or (3) is a Class C misdemeanor, except an offense under
Subsection (a)(2) or (3) is a Class A misdemeanor if the offense is
committed against a sports official in relation to the official's duties.
Redefines "family." Defines "sports official."  Makes conforming changes. 

SECTION 2.Makes application of this Act prospective.

SECTION 3.Effective date: September 1, 1999.

SECTION 4.Emergency clause.
