BACKGROUND AND PURPOSE 

Currently, the Department of Public Safety (DPS) distributes 1,085,554
driver's handbooks annually at an agency cost of $231,797.44. S.B. 1169
authorizes DPS to sell advertising in any driver's handbook that it
publishes. This bill prohibits DPS from selling advertising that promotes
the sale of an alcoholic beverage or that promotes the business of a person
who manufactures, sells, or distributes an alcoholic beverage. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Subchapter A, Chapter 521, Transportation Code, by adding
Section 521.006, as follows: 

Sec. 521.006. ADVERTISING IN DRIVER'S HANDBOOK. (a) Authorizes the
Department of Public Safety (DPS) to sell advertising in any driver's
handbook that the DPS publishes, except as provided by Subsection (c).   

(b) Requires DPS to deposit proceeds from advertising to the credit of the
driver's handbook advertising account in the general revenue fund, which is
authorized to be appropriated only for the purpose of administration of
this chapter.   

(c) Prohibits DPS from selling advertising that promotes the sale of an
alcoholic beverage, as defined in Section 1.04 (Definitions), Alcoholic
Beverage Code, or that promotes the business of a person who manufactures,
sells, or distributes an alcoholic beverage. 

Effective date: 90 days after adjournment.
