DIGEST 

Currently, the Texas Railroad Commission (commission) regulates the LP-gas
(liquefied petroleum gas, (LPG) or propane) industry and issues licenses to
persons who handle LPG or LPG systems. Under commission rules, there are
various categories of licenses which have specific requirements for each.
S.B. 1184 would require persons who install or repair LPG motor or mobile
fuel systems that have an engine with a rating of over 25 horsepower obtain
a Railroad Commission Category L license. 

PURPOSE

As proposed, S.B. 1184 regulates activities permitted under certain
liquefied petroleum gas licenses. 

RULEMAKING AUTHORITY

Rulemaking authority is granted to the Railroad Commission in SECTION 1
(Section 113.102, Natural Resources Code) of this bill.  

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 113.082 and 113.102, Natural Resources Code, as
follows:  

Sec. 113.082. CATEGORIES OF LICENSEE; FEES. Authorizes a prospective
licensee in liquefied petroleum gas (LPG) to apply to the LPG division  the
Railroad Commission for a license to engage in work as a  retail and
wholesale dealer, except the sale and installation of LPG motors or mobile
fuel systems that have an engine with a rating of more than 25 horsepower;
or in the sale and installation of LPG motor or mobil fuel systems.  

Sec. 113.102. ADDITIONAL ACTIVITIES PERMITTED UNDER CATEGORY "E" LICENSES.
Authorizes the Railroad Commission, by rule, to permit a category "E"
licensee whose license was issued before September 1, 1999, to perform for
a reasonable period an activity described by category "L" of Section
113.082. Provides that this section expires September 1, 2001. Deletes
existing section regarding prior licenses. 

SECTION 2. Makes application of this Act retroactive.

SECTION 3. Effective date: September 1, 1999.

SECTION 4. Emergency clause.
