Currently, Texas public school teachers lack the explicit authority to
discipline a student verbally or by use of non-corporal punishment without
facing recourse from local or state education officials for such actions.
This fear often results in a teacher's only recourse for an unruly student
is to sending the student to the principal's office. S.B. 1213would
establish discipline management techniques that a public school teacher may
use.
PURPOSE
As proposed, S.B. 1213 establishes discipline management techniques that a
publiic school teacher may use.
RULEMAKING AUTHORITY
This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Chapter 37A, Education Code, by adding Section 37.0021,
as follows:
Sec. 37.0021. OTHER DISCIPLINE MANAGEMENT AUTHORIZED FOR TEACHERS. Sets
forth discipline management techniques which a teacher is authorized to use
under other law and school district policy, in addition to removing a
student from class. Prohibits certain individuals from disciplining a
teacher in any manner for an action the teacher takes in accordance with
this section.
SECTION 2. Provides that this Act applies beginning with the 1999-2000
school year.
SECTION 3. Emergency clause.
Effective date: upon passage.
