SRC-PNG S.B. 1244 76(R) BILL ANALYSIS Senate Research Center S.B. 1244 By: Brown Finance 4/9/1999 As Filed DIGEST Currently, the regulation of auctioneers is enforced by one part-time investigator at the Texas Department of Licensing and Regulation. This bill would allow the use of a certain percentage of the auctioneers' account in the general revenue fund to be used to increase the regulation of auctioneers in this state. PURPOSE As proposed, S.B. 1244 regulates the disposition of revenues regarding the regulation of auctioneers. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 8700, V.T.C.S., by adding Section 5, as follows: Sec. 5. DISPOSITION OF REVENUES. Requires all money collected by the Texas Department of Licensing and Regulation (TDLR) under this Act, except money that is required to be deposited in the auctioneer education and recovery fund, to be deposited to the credit of the auctioneers' account in the general revenue fund and may be used only to administer this chapter. Authorizes the commissioner of the Department of Licensing and Regulation (commissioner) to allocate not more than 20 percent of the money in the auctioneers' account to cover TDLR's administrative costs. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
