HBA-TYH S.B. 1257 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1257 By: Nelson Urban Affairs 5/5/1999 Engrossed BACKGROUND AND PURPOSE Current law authorizes municipalities with 50,000 or more inhabitants to enter into developer participation contracts without complying with the competitive bidding procedure of Chapter 252 (Purchasing and Contracting Authority of Municipalities), Local Government Code. S.B. 1257 decreases from 50,000 to 5,000 the minimum number of inhabitants of a municipality to which that law applies. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 212.071, Local Government Code, to decrease from 50,000 to 5,000 the minimum number of inhabitants a municipality needs to contract with a developer of a subdivision or land in the municipality to construct public improvements without complying with the competitive sealed bidding procedure of Chapter 252 (Purchasing and Contracting Authority of Municipalities). SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
