DIGEST 

Currently, under Texas law, municipalities with 50,000 or more inhabitants
are authorized to enter into developer participation contracts, without
complying with the competitive sealed bidding procedure of Chapter 252 of
the Local Government Code.  This bill would authorize municipalities with
5,000 or more inhabitants to contract with developers to construct public
improvements related to the development. 

PURPOSE

As proposed, S.B. 1257 authorizes municipalities with 5,000 or more
inhabitants to contract with developers to construct public improvements
related to a development. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 212.071, Local Government Code, to authorize
municipalities with 5,000 or more inhabitants, rather than 50,000 or more
inhabitants, to contract with developers to construct public improvements
related to a development. 

SECTION 2. Effective date: September 1, 1999.

SECTION 3. Emergency clause.
