SRC-ARR S.B. 1270 76(R) BILL ANALYSIS Senate Research Center S.B. 1270 By: Wentworth Natural Resources 3/29/1999 As Filed DIGEST Currently, Texas law allows landowners to establish water quality protection zones in the extraterritorial jurisdiction and "outside the corporate limits" of cities with a population greater than 5,000. To establish such a plan, the landowner must get the plan approved by the Texas Natural Resource Conservation Commission (TNRCC). S.B.1270 would allow those areas that have been subjected to limited purpose annexation to be included in a water quality protection zone and to be provided with a full range of municipal services under a plan approved by TNRCC. PURPOSE As proposed, S.B. 1270 designates water quality protection zones in certain areas. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 26.179(c), Water Code, to provide that this section applies only to those areas within the extraterritorial jurisdiction, outside the full-purpose corporate limits of a municipality with a population greater than 5,000. Effective date: 90 days after adournment.
