DIGEST 

Currently, Chapter 242, Health and Safety Code, specifies that medication
permits are valid for one year, renewable only on December 31st, regardless
of the initial application date.  Therefore, the simultaneous renewal of
the permits of 7,000 medication aides requires the Texas Department of
Health to hire several temporary workers to process applications and fees.
S.B. 1293 allows staggered permit renewal dates, and requires accordingly
prorated fees. 

PURPOSE

As proposed, S.B. 1293 allows staggered permit renewal dates, and requires
accordingly prorated fees. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 242.610, Health and Safety Code, by amending
Subsection (e), and adding Subsection (g), to authorize the Texas
Department of Health to shorten permit terms to stagger permit renewal.
Requires the fee assessed under Section 242.611 to be prorated
appropriately, if a permit is issued for a term of less than one year.
Makes conforming changes. 

SECTION 2.Emergency clause.
  Effective date:  upon passage.
