DIGEST 

Currently, Texas law requires certain water conservation measures. S.B.
1301 would further regulate water conservation measures required in a
county during a declared drought disaster.  

PURPOSE

As proposed, S.B. 1301 regulates water conservation measures required in a
county during a declared drought disaster.  

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 16.055, Water Code, by adding Subsections (g),
(h), and (i), as follows: 

(g) Requires appropriate water conservation measures as adopted by the
county to be implemented throughout the county, immediately upon the
declaration of a state of disaster due to drought conditions. 

(h) Requires each county in the state, no later than December 31, 1999, to
adopt an enforceable plan which contains the appropriate water conservation
measures to be implemented under Subsection (g) of this section. Authorizes
the plan to be subsequently amended as appropriate.  

(i) Requires the Texas Water Development Board, Texas Natural Resource
Conservation Commission, Parks and Wildlife Department, and the Department
of Agriculture, upon request, to make available to a county appropriate
technical assistance for the development of water conservation measures to
be included in a plan adopted under Subsection (h) of this section. 

SECTION 2. Effective date: September 1, 1999.

SECTION 3. Emergency clause.
