DIGEST 

Currently, Texas law exempts libraries operated as a part of the university
system or institution of higher education from the normal purchasing
requirements set forth for those institutions.  These libraries are subject
only to the internal policies in the institutions of which they are a part,
but this exemption does not apply to junior colleges.  C.S.S.B. 1363 would
authorize the acquisition of library materials  by a junior college
district. 

PURPOSE

As proposed, C.S.S.B. 1363 authorizes the acquisition of library materials
by a junior college district. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 130A, Education Code, by adding Section 130.010,
as follows: 

Sec. 130.010.  ACQUISITION OF LIBRARY MATERIALS.  Defines "library goods
and services."  Authorizes a junior college district to acquire library
goods and services in any manner authorized by law for the acquisition of
library goods and services by a public senior college or university, as
defined by Section 61.003, notwithstanding any other law governing
purchasing by a junior college district. 

SECTION 2.  Emergency clause.
            Effective date: upon passage.
