SRC-AXB S.B. 1390 76(R) BILL ANALYSIS Senate Research Center S.B. 1390 76R7537 BDH-FBy: Shapleigh State Affairs 4/7/1999 As Filed DIGEST During the 75th Legislature, the Records Management Interagency Coordinating Council (council) gained the responsibility of studying the use, management, and protection of electronic state records. Thereafter, detailed and valuable recommendations were developed; however, in order to implement these suggestions, council member agencies require the ability to hire additional staff to manage electronic records programs. S.B. 1390 creates and expands responsibilities and authority for the council, effectively allowing the employment of additional staff. PURPOSE As proposed, S.B. 1390 creates and expands responsibilities and authority for the Records Management Interagency Coordinating Council. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 441.203(d)-(f), Government Code, to require the state records administrator to serve as executive secretary of the Records Management Interagency Coordinating Council (council). Authorizes the Texas State Library and Archives Commission (commission) and the General Services Commission (GSC) to employ staff to administer their state records management programs and to assist the council under Subsection (e). Requires the council's other member agencies to provide any additional staff required by the council. Authorizes the commission and GSC to enter into a contract to assist the council, subject to approval of the council and to available funds. Requires the council to study certain issues related to electronic state records, and authorizes the council to require other state agencies to cooperate in the study. Makes conforming changes. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
