HBA-DMD S.B. 1416 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1416 By: West State Affairs 5/5/1999 Engrossed BACKGROUND AND PURPOSE Currently, the construction provisions governing projects of the General Services Commission (commission) only require an advertisement in newspapers and the Texas Register. S.B. 1416 requires the commission to advertise for bids or proposals for certain construction projects in an electronic format. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2166.253(a) and (b), Government Code, as follows: (a) Includes an advertisement in an electronic format as required by Section 2155.083, Government Code, as a format that the General Service Commission (commission) is required to advertise in after final approval of a project's working plans and specifications and their acceptance by a using agency. Makes conforming changes. (b) Includes a reference to Subsection (d) as an exception to the commission's requirement to allow bidders not less than 30 days after the date the commission issues the bid documents to respond to an invitation to bid. Makes conforming changes. SECTION 2.Emergency clause. Effective date: upon passage.
