Reese Air Force Base was closed during the last round of closures, and the authority is responsible for overseeing the transition of the base from a military operation to a variety of uses. To correct current land tract descriptions currently in statute, S.B. 1428 sets forth legal descriptions of land tracts in the authority. PURPOSE As enrolled, S.B. 1428 sets forth legal descriptions of land tracts in the Lubbock Reese Redevelopment Authority. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 396A, Local Government Code, by amending Section 396.009 and adding Section 396.010, as follows: Sec. 396.009. DESCRIPTION OF TRACTS. Sets forth legal descriptions of land tracts 150 in the Lubbock Reese Redevelopment Authority (authority). Redesignates existing tracts 3 as 51, 4 as 52, and 6, 7, 8 as 53, 54, and 55. Deletes existing sections regarding Tracts 1,2, and 5. Sec. 396.010. FINDINGS RELATED TO TRACTS. Provides that the legislature finds that the authority includes the specific tracts of land described by Section 396.009, and includes other property in connection with Reese Air Force Base. Provides that the property within the authority's jurisdictional boundaries excludes property previously transferred by the United States of America. SECTION 2. Amends Chapter 2311B, Government Code, by amending Section 2311.026 and adding Section 2311.027, as follows: Sec. 2311.026. DESCRIPTION OF TRACTS. Sets forth legal descriptions of land tracts 1-50 in the authority. Redesignates existing tracts 3 as 51, 4 as 52, and 6, 7, 8 as 53, 54, and 55. Deletes existing sections regarding Tracts 1,2, and 5. Sec. 231.027. FINDINGS RELATED TO TRACTS. Makes conforming changes. SECTION 3. (a) Effective date: September 1, 1999. (b) Provides that SECTION 1 of this Act takes effect only if the Act of the 76th Legislature, Regular Session, 1999, relating to nonsubstantive additions to and corrections in enacted codes takes effect. (c) Provides that SECTION 2 of this Act takes effect only if the Act of the 76th Legislature, relating to nonsubstantive additions to and corrections in enacted codes does not take effect. SECTION 4.
