SRC-ARR S.B. 1476 76(R) BILL ANALYSIS Senate Research Center S.B. 1476 By: Brown Natural Resources 3/22/1999 As Filed DIGEST Currently, Texas law provides detailed procedures and requirements for applications for interbasin transfers. The certain law delineates certain types of interbasin transfers that were exempted from certain steps, except for the requirement that the transfer be authorized by the Texas Natural Resource Conservation Commission. S.B. 1476 removes the "exemptions" that are presently granted to certain categories of interbasin transfers. PURPOSE As proposed, S.B. 1476 authorizes exceptions to requirements governing the authorization of an interbasin transfer. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Subsection (v), Section 11.085, Water Code (providing that certain provisions do not apply to proposed emergency transfers of water). SECTION 2. Makes application of this Act prospective. SECTION 3. Emergency clause. Effective date: upon passage.
