DIGEST 

Currently, certain Texas counties do not have statutory authority to
require food training for management personnel. However, some large home
rule cities may already require proper food training through city
ordinances. S.B. 1477 will allow counties with a population of 2.8 million
or more to require a trained food manager to be on duty during each day of
operation of a food service establishment. 

PURPOSE

As enrolled, S.B. 1477 allows counties with a population of 2.8 million or
more to require a trained food manager to be on duty during each day of
operation of a food service establishment. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 437.0123(a), Health and Safety Code, to authorize
a county with a population of at least 2.8 million to require a trained
food manager to be on duty during each day of operation of a food service
establishment. Provides that the training required of food managers can be
no more extensive than that specified under Chapter 438D. Prohibits a food
establishment that handles only prepackaged food and does not prepare or
package food from being required to have a certified food manager under
this section. 

SECTION 2. Emergency clause.
           Effective date: 90 days after adjournment.
