However, some large home rule cities may already require proper food training through city ordinances. S.B. 1477 would allow counties with a population of 2.8 million or more to require a trained food manager to be on duty during operating hours of a food service establishment. PURPOSE As proposed, S.B. 1477 allows counties with a population of 2.8 million or more to require a trained food manager to be on duty during operating hours of a food service establishment. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 437.0123(a), Health and Safety Code, to authorize a county with a population of at least 2.8 million to require a trained food manager to be on duty during the operating hours of a food establishment. Provides that the training required of food managers can be no more extensive than that specified under Chapter 438D. Prohibits a food establishment that handles only prepackaged food and does not prepare or package food from being required to have a certified food manager under this section. SECTION 2. Emergency clause. Effective date: 90 days after adjournment.
