DIGEST 

Currently, the maximum weight limitation postings on certain roads and
bridges are allowed to be less than the statutory limit if it is determined
that more weight would cause rapid deterioration or destruction.  However,
the attorney general determined that heavy vehicles carrying a special
tolerance permit issued by provisions of the Transportation Code are not
required to abide by the posted limit.  Such vehicles have proved to be
particularly harmful to certain county roads and state highways.  S.B. 1496
expands the limitations of a special tolerance permit for heavy vehicles. 

PURPOSE

As proposed, S.B. 1496 expands limitations of a permit issued under Section
623.011(c), Transportation Code. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 623.011(c), Transportation Code, to specify that
a permit issued under this section does not authorize the operation of a
vehicle on certain roadways if the vehicle is too heavy, or on certain
bridges and culverts with posted maximum weight and load limits which the
vehicle exceeds. 

SECTION 2.  Emergency clause.
  Effective date:  90 days after adjournment.
