DIGEST 

Currently, under Texas law, only counties with a population of 20,000 or
less or a municipality with a population of 10,000 or less may jointly
erect, acquire, equip, and operate an auditorium, and are prohibited from
jointly erecting, acquiring, equipping, maintaining and operating an
exposition center, civic center, or convention center.  This bill allows
counties and municipalities to jointly erect, acquire, equip, maintain, and
operate an auditorium, exposition center, civic center, or convention
center. 

PURPOSE

As enrolled, S.B. 1512 authorizes certain counties and municipalities to
jointly establish certain recreational and cultural facilities. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends the heading of Chapter 301, Local Government Code, as
follows: 

CHAPTER 301.  New heading: RECREATIONAL AND CULTURAL FACILITIES JOINTLY
ESTABLISHED BY COUNTIES AND MUNICIPALITIES. 

SECTION 2.  Amends Sections 301.001-301.003 and 301.006-301.008, Local
Government Code, as follows: 

Sec.  301.001.  New heading: AUTHORITY TO ESTABLISH RECREATIONAL OR
CULTURAL FACILITY.  Defines "recreational or cultural facility."
Authorizes the commissioners court of a county and the governing body of a
municipality in that county to jointly erect, acquire, equip, maintain, and
operate a recreational or cultural facility, rather than an auditorium.
Deletes population requirements for the counties and municipalities. 

Sec.  301.002.  New heading: FINANCING OF RECREATIONAL OR CULTURAL
FACILITY.  Makes a conforming change. 

Sec.  301.003.  DELEGATION OF AUTHORITY TO BOARD OF MANAGERS; DONATIONS.
Makes conforming changes. 

Sec.  301.006.  AUTHORITY OF BOARD TO CONTRACT.  Makes conforming changes.

Sec.  301.007.  FINANCIAL STATEMENT AND BUDGET.  Makes conforming and
nonsubstantive changes. 

Sec.  301.008.  PERSONNEL.  Makes conforming changes.

SECTION 3.Effective date: September 1, 1999.

SECTION 4.Emergency clause.
