SRC-JXG C.S.S.B. 1545 76(R)BILL ANALYSIS Senate Research CenterC.S.S.B. 1545 By: Sibley Administration 4/6/1999 Committee Report (Substituted) DIGEST Currently, Texas law authorizes the Texas State Cemetery Committee (committee) to authorize the burial of a person only during a period in which the legislature is not convened, and only if the committee finds that the person to be buried made a significant contribution to Texas history. C.S.S.B. 1545 would authorize the committee to act on emergency burial requests during the legislative session when it is not practical, feasible, or possible to delay burial until the legislature or governor can act on the request and a concurrent resolution or proclamation can be obtained, and would require the person to have made a significant contribution to Texas history. PURPOSE As proposed, C.S.S.B. 1545 authorizes the Texas State Cemetery Committee to act on emergency burial requests during a legislative session. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2165.256(e), Government Code, to delete text regarding burial in the State Cemetery only during a period in which the legislature is not convened in regular or special session. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause. SUMMARY OF COMMITTEE CHANGES SECTION 1. Amends Section 2165.256(e), Government Code, to reinstate previously deleted text authorizing the Texas State Cemetery Committee (committee) by order to authorize a burial under Subsection (d)(6), only if the committee finds that the person made a significant contribution to Texas history.
