DIGEST 

Currently, Texas law states that the property dedicated to the State
Cemetery consists of 50 acres. However, the actual survey of the State
Cemetery property is 44.07 acres, rather than 50 acres. A majority of the
44.07 acres is in the flood plain and not suitable for cemetery purposes.
S.B. 1546 will correct the legal description, and will add 2.120 acres to
the State Cemetery property.  

PURPOSE

As enrolled, S.B. 1546 revises the legal description of the property
dedicated to the State Cemetery. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 2165.256(b), Government Code, to set forth the
legal description of the property dedicated for cemetery purposes as part
of the State Cemetery, in addition to the property described as Lot No. 5,
Division B, City of Austin, Travis County, Texas. Deletes existing legal
description of the property. 

SECTION 2. Effective date: September 1, 1999.

SECTION 3. Emergency clause.
