DIGEST 

Currently, Texas law regarding trespassing is applied only to real property
or buildings, and not to boats, aircraft or motor-propelled vehicles.
Thus, airport security has been unable to use the trespass statute to deal
with passengers who violate certain conditions.  S.B. 1558 would establish
the offense of trespassing on an aircraft. 

PURPOSE

As proposed, S.B. 1558 establishes the offense of trespassing on an
aircraft. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 30.05(a), Penal Code, to provide that a person
commits an offense if he enters or remains on property, including an
aircraft, of another without effective consent or he enters or remains in a
building of another without effective consent and he fulfills certain
conditions. 

SECTION 2.  Effective date: September 1, 1999.

SECTION 3.  Emergency clause.
