SRC-PNG S.B. 1659 76(R) BILL ANALYSIS Senate Research Center S.B. 1659 By: Jackson Natural Resources 4/12/1999 As Filed DIGEST Currently, under Texas law, the Brazos River Harbor Navigation District of Brazoria County does not have a District Treasurer, relying on the Tax Assessor and Collector for Brazoria County. This bill would establish the Office of District Treasurer of Brazos River Harbor Navigation District. PURPOSE As proposed, S.B. 1659 establishes the Office of District Treasurer of the Brazos River Harbor Navigation District of Brazoria County. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 58, Acts of the 62nd Legislature, Regular Session, 1971, by adding Section 2 and Section 3, as follows: Sec. 2. Establishes the Office of District Treasurer of the Brazos River Harbor Navigation District of Brazoria County (office). Requires the office to be held by the person appointed by the Board of Navigation and Canal Commissioners (board) of the Brazos River Harbor Navigation District (district). Requires the person holding the office to perform all duties for the district as have been previously performed by the county treasurer of Brazoria County. Requires the tax assessor and collector for Brazoria County or such other official performing the duties of the tax assessor and collector to deposit all collected taxes for the district in the depository bank designated as depository for Brazoria County and transfer and deposit the funds to the account of the district in the depository bank that is designated as depository for the district. Sec. 3. Requires the person holding the office to execute a good and sufficient bond payable to the board for the benefit of the district in an amount fixed and approved by the board, before receiving any district funds from any source. SECTION 4. Effective date: September 1, 1999. SECTION 5. Emergency clause.
