DIGEST 

Currently, the Texas Penal Code bans licensed handguns from school
premises.  Due to the definitions of certain terms, people with a concealed
handgun permit are allowed to legally have their licensed guns in their
vehicles while in school parking lots, which effectively circumvents state
and federal weapon-free school zone laws.  S.B. 1729 would establish
provisions regarding the possession or carrying of weapons on certain
premises associated with a school or educational institution,  and would
provide penalties.  

PURPOSE

As proposed, S.B. 1729 establishes provisions regarding the possession or
carrying of weapons on certain premises associated with a school or
educational institution, and would  provide penalties.  

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 46.03(c), Penal Code, to provide that in this
section "premises" has the meaning assigned by Section 46.035, except as
provided by Subdivision (2).  Provides that "premises," for the purposes of
Subsection (a)(1), means all or a portion of a building, a public or
private driveway, street, sidewalk or walkway, parking lot, parking garage,
or other parking area. Makes a conforming change. 

SECTION 2.  Makes application of this Act prospective.

SECTION 3.  Effective date: September 1, 1999.

SECTION 4.  Emergency clause.
