DIGEST 

Hidalgo County wishes to contract with a private vendor for the design of a
local jail facility that the county would run upon completion.  However,
Section 351.103, Local Government Code lists ten requirements that must be
contained  in a contract with a private vendor, which assume that the
private vendor will run  or manage the facility such as to requiring the
vendor to make certain provisions.  S.B. 1730 would establish conditions
regarding county contracts with private entities for jail facilities. 

PURPOSE

As proposed, S.B. 1730 establishes conditions regarding county contracts
with private entities for jail facilities. 
 
RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 351.103 , Local Government Code, to require the
inclusion of certain language in a contract made under Section 351.102
regarding requirements if the contract includes operation of the facility
by a private vendor.  Makes conforming changes. 

SECTION 2.  Effective date: September 1, 1999.

SECTION 3.  Emergency clause.
