DIGEST 

Hidalgo County wishes to contract with a private vendor for the design of a
local jail facility that the county would run upon completion.  However,
Section 351.103, Local Government Code lists 10 requirements that must be
contained  in a contract with a private vendor, which assume that the
private vendor will run  or manage the facility such as to requiring the
vendor to make certain provisions.  C.S.S.B. 1730 would establish
conditions regarding county contracts with private entities for jail
facilities. 

PURPOSE

As proposed, C.S.S.B. 1730 establishes conditions regarding county
contracts with private entities for jail facilities. 
 
RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 351.103, Local Government Code, to require a
contract made under Section 351.102, if the contract includes operation or
management of the facility by a private vendor, to require the private
vendor to operate the facility in compliance with minimum standards adopted
by the Commission on Jail Standards.  Makes conforming changes. 

SECTION 2.  Emergency clause.
            Effective date: upon passage.


SUMMARY OF COMMITTEE CHANGES

regarding the operation or management of private vendors regarding
contracts made under Section 351.103.
