DIGEST 

Currently, Texas law provides a calculation for computing the payment of
arrearages, which is often impractical, especially for lower-income
obligors with large arrearages.  This leaves a judge in the position of
either ignoring the guidelines or setting payments that may never pay off
the arrearage. S.B. 1739 would establish provisions regarding the
withholding of child support arrearages. 

PURPOSE

As proposed, S.B. 1739 establishes provisions regarding the withholding of
child support arrearages. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 158.003(b), Family Code, to delete text
regarding an additional amount to be withheld to discharge arrearages in
not more than two years or an additional 20 percent added to the current
monthly support order.  Makes a conforming change. 

SECTION 2.  Amends Section 158.004, Family Code, to make conforming changes.

SECTION 3.  Makes application of this Act prospective.

SECTION 4.  Effective date: September 1, 1999.

SECTION 5.  Emergency clause.
