DIGEST 

Currently, under Texas law, gas utilities or municipally owned utilities
may refuse to provide services to a school district even if pipeline
capacity is available on an existing facility of the utility. This would
prohibit a gas utility or municipally owned utility from refusing to
provide services to a school district under certain circumstances. 

PURPOSE

As proposed, S.B. 1797  prohibits a gas utility or municipally owned
utility from refusing to provide services to a school district under
certain circumstances. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 104.254, Utilities Code, to prohibit a gas
utility or municipally owned utility from refusing to provide services to a
school district if pipeline capacity is available on an existing facility
of the utility. 

SECTION 2.  Effective date: September 1, 1999.

SECTION 3. Emergency clause.
