HBA-CDB S.B. 1846 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1846 By: Brown State Affairs 4/29/1999 Engrossed BACKGROUND AND PURPOSE Currently, the Government Code excepts the contact information of Texas peace officers and information regarding their families from public disclosure. However, if a peace officer is killed in the line of duty, that exception ceases to be extended to the deceased and the family of the deceased. S.B. 1846 creates an exception from disclosure of certain personal information regarding a peace officer killed in the line of duty. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 552.117, Government Code, to include peace officers, reserve law enforcement officers, commissioned deputy game wardens, and certain corrections officers who are killed in the line of duty, on a list of individuals whose personal and contact information is excepted from required public disclosure, regardless of whether these deceased individuals complied with Section 552.024 (Electing to Disclose Address and Telephone Number), Government Code. Makes a conforming change. SECTION 2.Makes application of this Act prospective and retroactive. SECTION 3.Emergency clause. Effective date: upon passage.
