SRC-DPW S.B. 1868 76(R) BILL ANALYSIS Senate Research Center S.B. 1868 By: Truan State Affairs 4/20/1999 As Filed DIGEST Currently, Texas law does not grant volunteer investigators who provide services to the Texas Board of Professional Land Surveying (board) immunity from civil or criminal liability arising from an act or omission in the course of performing an investigation, except under certain conditions. This bill would grant immunity from civil or criminal liability to volunteer investigators who provide services to the board. PURPOSE As proposed, S.B. 1868 authorizes the Texas Board of Professional Land Surveying to use the services of volunteers in performing investigations and grants immunity from liability to such volunteers. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 24, Article 5282c, V.T.C.S. (Professional Land Surveying Practices Act), to authorize the Texas Board of Professional Land Surveying to use the services of volunteers in performing investigations. Provides that volunteers are immune from civil or criminal liability arising from an act or omission in the course of performing an investigation unless such action is done in bad faith or malice. SECTION 2.Emergency clause. Effective date: upon passage.
