DIGEST 

Currently, some individuals who seek passage into the United States are
forced into horrid conditions that can lead to death, by the people who
transport them for profit.  S.B. 1885 creates an offense for a person who
transports an individual for money in a way that conceals that individual
from law enforcement authorities, and is likely to inflict serious bodily
injury or death to that individual. 

PURPOSE

As proposed, S.B. 1885 creates a state jail offense for a person who
transports an individual for money in a way that conceals that individual
from law enforcement authorities, and is likely to inflict serious bodily
injury or death to that individual. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 20, Penal Code, by adding Section 20.05, as
follows: 

Sec.  20.05.  UNLAWFUL TRANSPORT.  Creates an offense for transporting a
person for money, in a way that conceals the person from law enforcement
authorities, and is likely to inflict serious bodily injury or death to
that person.  Provides that such an offense is a state jail felony. 

SECTION 2.  Effective date:  September 1, 1999.

SECTION 3.  Emergency clause.

transported person as an offense.
