DIGEST 

Certainly, Texas law provides for navigation districts. S.B. 1905 would set
forth requirements for acquisition of certain property by navigation
districts.  

PURPOSE

As proposed, S.B. 1905 sets forth requirements for acquisition of certain
property by navigation districts.  

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 60.101, Water Code, by adding a new Subsection
(b) and relettering existing Subsection (b) as Subsection (c), to authorize
a navigation district (district) to acquire property to be held for future
use as an aid or facility incidental to or useful in the operation or
development of a port or waterway or in aid of navigation-related commerce.
Authorizes property owned and held by a district for future use to be
rented or leased for compensation to a private enterprise for use by the
private enterprise for a purpose not related to the duties and functions of
the district. Makes conforming changes.  

SECTION 2. Amends Section 11.11, Tax Code, by adding Subsection (i), to
provide that real property owned and held by a district for future use for
a purpose related by the duties and functions of the district and rented or
leased to a private person for compensation for a use not related to the
district's duties and functions, as authorized by Section 60.101(b), Water
Code, is considered used for public purposes and is exempt from taxation
under Subsection (a).  

SECTION 3. Effective date: January 1, 2000.

SECTION 4. Emergency clause.
