SRC-JXG S.J.R. 2 76(R) BILL ANALYSIS Senate Research Center S.J.R. 2 By: Sibley Intergovernmental Relations 3/31/1999 As Filed DIGEST The Jack County Commissioners Court has unanimously requested that the Legislature pass a resolution in support of a Constitutional Amendment to abolish the position of constable in Jack County. This resolution would save the county about $20,000 a year by eliminating the salaried position. S.J.R. 2 would abolish the position of constable in Jack County, with the duties of constable to be assumed by the Jack County Sheriff's Office. PURPOSE As proposed, S.J.R. 2 abolishes the position of constable in Jack County. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 18, Article V, Texas Constitution, by amending Subsection (a) and adding Subsection (h), to provide that the office of constable in Jack County is abolished. Provides that the functions of the office are transferred to the county sheriff. Provides that the office of constable is abolished under this subsection only if, at the statewide election at which the constitutional amendment providing for the abolition of the office in Jack County is submitted to the voters, a majority of the voters of Jack County voting on the question at the election favor the amendment. Makes a conforming change. SECTION 2. Provides that the abolition of the office of constable in Jack County under the constitutional amendment proposed by the 76th Legislature, Regular Session, 1999, providing for the abolition of the office in that county takes effect January 1, 2000, if the conditions of Section 18h, Article V, Texas Constitution, as added by that constitutional amendment, are met. Provides that this provision expires January 2, 2000. SECTION 3. Requires this proposed constitutional amendment to be submitted to the voters at an election to be held on November 2, 1999. Sets forth the required language for the ballot.
