                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the hunting of turkeys.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Subchapter A, Chapter 64, Parks and Wildlife
 1-5     Code, is amended by adding Section 64.008 to read as follows:
 1-6           Sec. 64.008.  WILD TURKEY HUNTING.  A person may not hunt a
 1-7     wild turkey with a firearm unless the person uses a shotgun.
 1-8           SECTION 2.  Section 43.581(a), Parks and Wildlife Code, is
 1-9     amended to read as follows:
1-10           (a)  Except as provided by Subsection (b), no person may hunt
1-11     wild deer[, turkey,] or javelina (collared peccary) during an open
1-12     season prescribed by law or by proclamation of the commission
1-13     during which only muzzleloaders may be used for hunting unless the
1-14     person has acquired a muzzleloader hunting stamp from the
1-15     department.  The commission by rule may prescribe requirements
1-16     relating to possessing a stamp required by this subchapter.
1-17           SECTION 3.  Section 43.584, Parks and Wildlife Code, is
1-18     amended to read as follows:
1-19           Sec. 43.584.  HUNTING LICENSE REQUIRED.  The purchase or
1-20     possession of a muzzleloader hunting stamp does not permit a person
1-21     to hunt wild deer[, turkey,] or javelina without the license
1-22     required by Chapter 42 of this code or by means not authorized by
1-23     this code.
1-24           SECTION 4.  This Act takes effect September 1, 1999.
 2-1           SECTION 5.  The importance of this legislation and the
 2-2     crowded condition of the calendars in both houses create an
 2-3     emergency and an imperative public necessity that the
 2-4     constitutional rule requiring bills to be read on three several
 2-5     days in each house be suspended, and this rule is hereby suspended.
