                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to placement of the state seal on the athletic uniform of
 1-3     teams representing public institutions of higher education.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter Z, Chapter 51, Education Code, is
 1-6     amended by adding Section 51.9246 to read as follows:
 1-7           Sec. 51.9246.  DISPLAY OF STATE SEAL ON ATHLETIC TEAM
 1-8     UNIFORMS.  (a)  In this section, "general academic teaching
 1-9     institution" has the meaning assigned by Section 61.003.
1-10           (b)  A team organized by a  general academic teaching
1-11     institution that participates in an intercollegiate sport, game, or
1-12     other competition involving substantial physical ability or
1-13     physical skill shall affix a representation of the state seal on
1-14     the uniform used by each team participant.
1-15           (c)  The representation of the state seal must:
1-16                 (1)  be visible to spectators of the competition;
1-17                 (2)  be placed prominently on the uniform; and
1-18                 (3)  be at least as large as any other logo,
1-19     representation, or symbol on the uniform, including any symbol
1-20     affixed by the manufacturer of the uniform, other than:
1-21                       (A)  the logo, representation, or symbol of the
1-22     general academic teaching institution or the institution's team
1-23     name; or
1-24                       (B)  the number or name identifying the
 2-1     participant.
 2-2           SECTION 2.  This Act takes effect September 1, 1999.
 2-3           SECTION 3.  The importance of this legislation and the
 2-4     crowded condition of the calendars in both houses create an
 2-5     emergency and an imperative public necessity that the
 2-6     constitutional rule requiring bills to be read on three several
 2-7     days in each house be suspended, and this rule is hereby suspended.
 2-8                          COMMITTEE AMENDMENT NO. 1
 2-9           Amend H.B. No. 33 by inserting the following on page 1, line
2-10     14 after the period:
2-11           The seal shall be affixed in conformance with the rules of
2-12     the national association for the promotion and regulation of
2-13     intercollegiate athletics of which the institution is a member.
