                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the filing of a declaration of write-in candidacy in
 1-3     elections for trustees of independent school districts.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 11.056(b), Education Code, is amended to
 1-6     read as follows:
 1-7           (b)  A declaration of write-in candidacy must be filed not
 1-8     later than 5 p.m.  of the 45th [fifth] day before election day.
 1-9     However, if a candidate whose name is to appear on the ballot dies
1-10     or is declared ineligible after the 48th day before election day, a
1-11     declaration of write-in candidacy for the office sought by the
1-12     deceased or ineligible candidate may be filed not later than 5 p.m.
1-13     of the 42nd day before election day [after the date an application
1-14     for a place on the ballot is required to be filed].
1-15           SECTION 2.  This Act takes effect September 1, 1999.
1-16           SECTION 3.  The importance of this legislation and the
1-17     crowded condition of the calendars in both houses create an
1-18     emergency and an imperative public necessity that the
1-19     constitutional rule requiring bills to be read on three several
1-20     days in each house be suspended, and this rule is hereby suspended.
