                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the creation of the offense of discharging a firearm at
 1-3     a sport shooting range while intoxicated.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 46, Penal Code, is amended by adding
 1-6     Section 46.14 to read as follows:
 1-7           Sec. 46.14.  DISCHARGING FIREARM AT SPORT SHOOTING RANGE
 1-8     WHILE INTOXICATED.  (a)  In this section:
 1-9                 (1)  "Intoxicated" has the meaning assigned by Section
1-10     49.01.
1-11                 (2)  "Sport shooting range" has the meaning assigned by
1-12     Section 250.001,  Local Government Code.
1-13           (b)  A person commits an offense if the person discharges a
1-14     firearm at a sport shooting range while the person is intoxicated.
1-15           (c)  The owner or operator of a sport shooting range commits
1-16     an offense if the owner or operator allows a person to discharge a
1-17     firearm at the shooting range while the person is intoxicated.
1-18           (d)  An offense under this section is a Class B misdemeanor.
1-19           SECTION 2.  This Act takes effect September 1, 1999.
1-20           SECTION 3.  The importance of this legislation and the
1-21     crowded condition of the calendars in both houses create an
1-22     emergency and an imperative public necessity that the
1-23     constitutional rule requiring bills to be read on three several
1-24     days in each house be suspended, and this rule is hereby suspended.
