                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to furnishing printed copies of state publications
 1-3     released only in an electronic format to the Texas State Library.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 441.103(c), Government Code, is amended
 1-6     to read as follows:
 1-7           (c)  On the release of a state publication in an electronic
 1-8     format and for the purpose of further distribution of the
 1-9     publication, a state agency shall provide the Texas State Library:
1-10                 (1)  either:
1-11                       (A)  on-line access to the publication; or
1-12                       (B) [(2)]  copies of the publication on an
1-13     electronic external storage device in the number of copies
1-14     prescribed by the commission but not to exceed 75; and
1-15                 (2)  if the publication is released in an electronic
1-16     format only, copies of the publication in a printed format in the
1-17     number of copies prescribed by the commission but not to exceed 75.
1-18           SECTION 2.  Section 441.104, Government Code, is amended to
1-19     read as follows:
1-20           Sec. 441.104.  DUTIES OF TEXAS STATE LIBRARY. The Texas State
1-21     Library shall:
1-22                 (1)  acquire, organize, and retain state publications;
1-23                 (2)  collect state publications and distribute them to
1-24     depository libraries;
 2-1                 (3)  establish a microform program for the preservation
 2-2     and management of state publications and make available state
 2-3     publications in microform to depository libraries and other
 2-4     libraries at a reasonable cost;
 2-5                 (4)  periodically issue a list of all state
 2-6     publications that it has received to all depository libraries and
 2-7     other libraries on request;
 2-8                 (5)  catalog, classify, and index all state
 2-9     publications that it receives and distribute the cataloging,
2-10     classification, and indexing information to depository libraries
2-11     and to other libraries on request;
2-12                 (6)  ensure that state publications are fully
2-13     represented in regional and national automated library networks;
2-14                 (7)  index all state publications that are available in
2-15     an electronic format and make the index available in an electronic
2-16     format and a printed format;
2-17                 (8)  provide on-line access to state publications that
2-18     can be accessed on-line;  [and]
2-19                 (9)  provide other depository libraries appropriate
2-20     access, at no charge, to state publications available in an
2-21     electronic format; and
2-22                 (10)  provide printed copies of state publications that
2-23     are available only in electronic format to depository libraries and
2-24     other libraries on request.
2-25           SECTION 3.  This Act takes effect September 1, 1999.
2-26           SECTION 4.  The importance of this legislation and the
2-27     crowded condition of the calendars in both houses create an
 3-1     emergency and an imperative public necessity that the
 3-2     constitutional rule requiring bills to be read on three several
 3-3     days in each house be suspended, and this rule is hereby suspended.
