A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to authorized activities of a winery permit holder in
1-3 certain counties.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 16.01(d), Alcoholic Beverage Code, is
1-6 amended to read as follows:
1-7 (d) The holder of a winery permit may sell wine to ultimate
1-8 consumers for consumption on or off winery premises and dispense
1-9 free wine for consumption on or off the winery premises if the
1-10 winery is located:
1-11 (1) in a city that:
1-12 (A) [(1)] is located in three or more counties,
1-13 at least one of which has a population of 500,000 or more; and
1-14 (B) [(2)] has within its boundaries all or part
1-15 of an international airport; or
1-16 (2) in a county that:
1-17 (A) has a population of 270,000 or more; and
1-18 (B) is adjacent to two or more counties with a
1-19 population of one million or more.
1-20 SECTION 2. This Act takes effect September 1, 1999.
1-21 SECTION 3. The importance of this legislation and the
1-22 crowded condition of the calendars in both houses create an
1-23 emergency and an imperative public necessity that the
1-24 constitutional rule requiring bills to be read on three several
2-1 days in each house be suspended, and this rule is hereby suspended.
