                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to records of a closed meeting held by a school board.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 551.103, Government Code, is amended to
 1-5     read as follows:
 1-6           Sec. 551.103.  CERTIFIED AGENDA OR [TAPE] RECORDING REQUIRED.
 1-7     (a)  Except as provided by Subsection (b), a [A] governmental body
 1-8     shall either keep a certified agenda or make a tape recording or
 1-9     other electronic recording of the proceedings of each closed
1-10     meeting other than[, except for] a private consultation permitted
1-11     under Section 551.071.
1-12           (b)  A school board or the governing body of a home-rule
1-13     school district, a campus or program charter, or an open enrollment
1-14     charter school shall make a tape recording or other electronic
1-15     recording of the proceedings of each closed meeting other than a
1-16     private consultation permitted under Section 551.071.
1-17           (c)  The presiding officer shall certify that an agenda kept
1-18     under Subsection (a)  is a true and correct record of the
1-19     proceedings.
1-20           (d) [(c)]  The certified agenda must include:
1-21                 (1)  a statement of the subject matter of each
1-22     deliberation;
1-23                 (2)  a record of any further action taken; and
1-24                 (3)  an announcement by the presiding officer at the
 2-1     beginning and the end of the meeting indicating the date and time.
 2-2           (e) [(d)]  A tape recording or other electronic recording
 2-3     made under Subsection (a) or (b) must include announcements by the
 2-4     presiding officer at the beginning and the end of the meeting
 2-5     indicating the date and time.
 2-6           SECTION 2.  This Act takes effect September 1, 1999.
 2-7           SECTION 3.  The importance of this legislation and the
 2-8     crowded condition of the calendars in both houses create an
 2-9     emergency and an imperative public necessity that the
2-10     constitutional rule requiring bills to be read on three several
2-11     days in each house be suspended, and this rule is hereby suspended.
