                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to certain interlocal contracts for the construction,
 1-3     improvement, or repair of streets and alleys in municipalities.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter C, Chapter 791, Government Code, is
 1-6     amended by adding Section 791.032 to read as follows:
 1-7           Sec. 791.032.  CONSTRUCTION, IMPROVEMENT, AND REPAIR OF
 1-8     STREETS IN MUNICIPALITIES.  (a)  This section applies only to an
 1-9     interlocal contract in which one of the parties to the contract is
1-10     a county in which there is only one incorporated municipality.
1-11           (b)  With the approval of the governing body of a
1-12     municipality, a local government may enter into an interlocal
1-13     contract with the municipality to finance the construction,
1-14     improvement, maintenance, or repair of streets or alleys in the
1-15     municipality, including portions of the municipality's streets or
1-16     alleys that are not an integral part of or a connecting link to
1-17     other roads or highways.
1-18           SECTION 2.  Section 251.012(a), Transportation Code, is
1-19     amended to read as follows:
1-20           (a)  With the approval of the governing body of a
1-21     municipality, the commissioners court of a county may spend county
1-22     money to finance the construction, improvement, maintenance, or
1-23     repair of a street or alley in the county that is located in the
1-24     municipality, including the provision of:
 2-1                 (1)  necessary roadbed preparation or material;
 2-2                 (2)  paving or other hard covering of the street or
 2-3     alley; [or]
 2-4                 (3)  curbs, gutters, bridges, or drainage facilities;
 2-5     or
 2-6                 (4)  any construction, improvement, maintenance, or
 2-7     repair allowed under Section 791.032, Government Code, if the
 2-8     commissioners court finds that the county will receive  benefits as
 2-9     a result of the work on the street or alley.
2-10           SECTION 3.  This Act takes effect September 1, 1999.
2-11           SECTION 4.  This Act does not apply to any other political
2-12     subdivision other than the political subdivisions described in
2-13     Section 1 or 2 of this Act.
2-14           SECTION 5.  The importance of this legislation and the
2-15     crowded condition of the calendars in both houses create an
2-16     emergency and an imperative public necessity that the
2-17     constitutional rule requiring bills to be read on three several
2-18     days in each house be suspended, and this rule is hereby suspended.
