A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to interlocal contracts for the construction, improvement,
1-3 or repair of streets and alleys in municipalities.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subchapter C, Chapter 791, Government Code, is
1-6 amended by adding Section 791.032 to read as follows:
1-7 Sec. 791.032. CONSTRUCTION, IMPROVEMENT, AND REPAIR OF
1-8 STREETS IN MUNICIPALITIES. With the approval of the governing body
1-9 of a municipality, a local government may enter into an interlocal
1-10 contract with the municipality to finance the construction,
1-11 improvement, maintenance, or repair of streets or alleys in the
1-12 municipality, including portions of the municipality's streets or
1-13 alleys that are not an integral part of or a connecting link to
1-14 other roads or highways.
1-15 SECTION 2. Section 251.012(a), Transportation Code, is
1-16 amended to read as follows:
1-17 (a) With the approval of the governing body of a
1-18 municipality, the commissioners court of a county may spend county
1-19 money to finance the construction, improvement, maintenance, or
1-20 repair of a street or alley in the county that is located in the
1-21 municipality, including the provision of:
1-22 (1) necessary roadbed preparation or material;
1-23 (2) paving or other hard covering of the street or
1-24 alley; [or]
2-1 (3) curbs, gutters, bridges, or drainage facilities;
2-2 or
2-3 (4) any construction, improvement, maintenance, or
2-4 repair allowed under Section 791.032, Government Code, if the
2-5 commissioners court finds that the county will receive benefits as
2-6 a result of the work on the street or alley.
2-7 SECTION 3. This Act takes effect September 1, 1999.
2-8 SECTION 4. The importance of this legislation and the
2-9 crowded condition of the calendars in both houses create an
2-10 emergency and an imperative public necessity that the
2-11 constitutional rule requiring bills to be read on three several
2-12 days in each house be suspended, and this rule is hereby suspended.
