1-8 A BILL TO BE ENTITLED
1-9 AN ACT
1-10 relating to interlocal contracts for the construction, improvement,
1-11 or repair of streets and alleys in municipalities.
1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13 SECTION 1. Subchapter C, Chapter 791, Government Code, is
1-14 amended by adding Section 791.032 to read as follows:
1-15 Sec. 791.032. CONSTRUCTION, IMPROVEMENT, AND REPAIR OF
1-16 STREETS IN MUNICIPALITIES. With the approval of the governing body
1-17 of a municipality, a local government may enter into an interlocal
1-18 contract with the municipality to finance the construction,
1-19 improvement, maintenance, or repair of streets or alleys in the
1-20 municipality, including portions of the municipality's streets or
1-21 alleys that are not an integral part of or a connecting link to
1-22 other roads or highways.
1-23 SECTION 2. Section 251.012(a), Transportation Code, is
1-24 amended to read as follows:
1-25 (a) With the approval of the governing body of a
1-26 municipality, the commissioners court of a county may spend county
1-27 money to finance the construction, improvement, maintenance, or
1-28 repair of a street or alley in the county that is located in the
1-29 municipality, including the provision of:
1-30 (1) necessary roadbed preparation or material;
1-31 (2) paving or other hard covering of the street or
1-32 alley; [or]
1-33 (3) curbs, gutters, bridges, or drainage facilities;
1-34 or
1-35 (4) any construction, improvement, maintenance, or
1-36 repair allowed under Section 791.032, Government Code, if the
1-37 commissioners court finds that the county will receive benefits as
1-38 a result of the work on the street or alley.
1-39 SECTION 3. This Act takes effect September 1, 1999.
1-40 SECTION 4. The importance of this legislation and the
1-41 crowded condition of the calendars in both houses create an
1-42 emergency and an imperative public necessity that the
1-43 constitutional rule requiring bills to be read on three several
1-44 days in each house be suspended, and this rule is hereby suspended.
