                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to part-time enrollment of home-school students in public
 1-3     schools.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter A, Chapter 25, Education Code, is
 1-6     amended by adding Section 25.005 to read as follows:
 1-7           Sec. 25.005.  PART-TIME ENROLLMENT OF HOME-SCHOOL STUDENT.
 1-8     (a)  A home-schooled child entitled to attend public school in a
 1-9     school district under Section 25.001 may enroll in public school in
1-10     the district as a part-time student if the district and the child's
1-11     parent or guardian agree in writing to the child's enrollment.
1-12           (b)  A part-time student may participate in an academic class
1-13     on the same basis as a regularly enrolled student.
1-14           (c)  A school district may not charge a part-time student
1-15     tuition but shall charge the student all applicable fees charged a
1-16     regularly enrolled student.
1-17           (d)  A school district that enrolls a part-time student under
1-18     this section is entitled to receive a portion of the total amount
1-19     of state funding the district receives per regularly enrolled
1-20     student.
1-21           (e)  The State Board of Education shall adopt rules as
1-22     necessary to implement this section, including rules that provide
1-23     for state funding proportionate to a student's participation in the
1-24     public school program.
 2-1           SECTION 2.  This Act applies beginning with the 1999-2000
 2-2     school year.
 2-3           SECTION 3.  The importance of this legislation and the
 2-4     crowded condition of the calendars in both houses create an
 2-5     emergency and an imperative public necessity that the
 2-6     constitutional rule requiring bills to be read on three several
 2-7     days in each house be suspended, and this rule is hereby suspended,
 2-8     and that this Act take effect and be in force from and after its
 2-9     passage, and it is so enacted.
