                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to construction, repair, and maintenance of roads in or
 1-3     adjacent to certain state parks and wildlife facilities.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 250, Transportation Code, is amended by
 1-6     adding Section 250.002 to read as follows:
 1-7           Sec. 250.002.  ROAD IN OR ADJACENT TO PARKS AND WILDLIFE
 1-8     FACILITY.  (a)  In this section, "parks and wildlife facility"
 1-9     means a state park, state fish hatchery, state wildlife management
1-10     area, or support facility for a state park, state fish hatchery, or
1-11     state wildlife management area.
1-12           (b)  Notwithstanding any other law, the department shall
1-13     construct, repair, and maintain roads in and adjacent to a parks
1-14     and wildlife facility.
1-15           (c)  If no state highway provides direct access to a parks
1-16     and wildlife facility, the department shall construct, repair, and
1-17     maintain any road necessary to provide access between the facility
1-18     and a state highway.  If the road is under the jurisdiction of a
1-19     municipality or county, the department shall enter an agreement
1-20     with the municipality or county under which the department
1-21     constructs, repairs, and maintains the road.
1-22           (d)  The department shall acquire any private land required
1-23     for right-of-way purposes.  If the Parks and Wildlife Department
1-24     does not have an easement, right-of-way, or similar access to a
 2-1     parks and wildlife facility, none may be obtained under this
 2-2     section without the express written consent of all affected private
 2-3     landowners.
 2-4           (e)  Construction, repairs, maintenance, or acquisitions made
 2-5     under this section shall be paid from the state highway fund.
 2-6           SECTION 2.  Section 13.013, Parks and Wildlife Code, and
 2-7     Section 1.02, Chapter 7, Acts of the 72nd Legislature, 1st Called
 2-8     Session, 1991, are repealed.
 2-9           SECTION 3.  The importance of this legislation and the
2-10     crowded condition of the calendars in both houses create an
2-11     emergency and an imperative public necessity that the
2-12     constitutional rule requiring bills to be read on three several
2-13     days in each house be suspended, and this rule is hereby suspended,
2-14     and that this Act take effect and be in force from and after its
2-15     passage, and it is so enacted.
