                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to prohibiting the sale of alcoholic beverages at drive-up
 1-3     windows.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.   Subchapter D, Chapter 109, Alcoholic Beverage
 1-6     Code, is amended by adding Section 109.61 to read as follows:
 1-7           Sec. 109.61.  DRIVE-UP WINDOW SALES PROHIBITED.  The holder
 1-8     of a license or permit issued under this code may not sell
 1-9     alcoholic beverages in a manner that allows a person to approach
1-10     the exterior of the licensed or permitted premises in a motor
1-11     vehicle and purchase any alcoholic beverage for off-premises
1-12     consumption without:
1-13                 (1)  exiting from the vehicle; or
1-14                 (2)  entering the interior of a building on the
1-15     licensed or permitted premises in a motor vehicle.
1-16           SECTION 2.  This Act takes effect September 1, 1999.
1-17           SECTION 3.  The importance of this legislation and the
1-18     crowded condition of the calendars in both houses create an
1-19     emergency and an imperative public necessity that the
1-20     constitutional rule requiring bills to be read on three several
1-21     days in each house be suspended, and this rule is hereby suspended.
