                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to a year of creditable service in the Teacher Retirement
 1-3     System of Texas.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 823.002, Government Code, is amended to
 1-6     read as follows:
 1-7           Sec. 823.002.  SERVICE CREDITABLE AS [IN] A YEAR.  (a)
 1-8     Except as provided by Subsections (b) and (c), the [The] board of
 1-9     trustees by rule shall determine how much service in any year is
1-10     equivalent to one year of service credit, but in no case may all of
1-11     a person's service in one school year be creditable as more than
1-12     one year of service.
1-13           (b)  Service for two full summers of summer school is
1-14     creditable as one year of service.
1-15           (c)  Service that has been credited by the retirement system
1-16     on annual statements for a period of five or more years may not be
1-17     deleted or corrected because of an error in crediting unless the
1-18     error concerns three or more years of service credit or was caused
1-19     by fraud.
1-20           SECTION 2.  The change in law made by this Act applies only
1-21     to service performed on or after the effective date of this Act.
1-22           SECTION 3.  This Act takes effect September 1, 1999.
1-23           SECTION 4.  The importance of this legislation and the
1-24     crowded condition of the calendars in both houses create an
 2-1     emergency and an imperative public necessity that the
 2-2     constitutional rule requiring bills to be read on three several
 2-3     days in each house be suspended, and this rule is hereby suspended.
