76R13188 CAS-D By Giddings H.B. No. 578 Substitute the following for H.B. No. 578: By Sadler C.S.H.B. No. 578 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to staff development training and certification in 1-3 cardiopulmonary resuscitation and first aid of school district 1-4 personnel. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Section 21.451(a), Education Code, is amended to 1-7 read as follows: 1-8 (a) The staff development provided by a school district must 1-9 be conducted in accordance with minimum standards developed by the 1-10 commissioner for program planning, preparation, and improvement. 1-11 The staff development: 1-12 (1) must include: 1-13 (A) technology training and training in conflict 1-14 resolution and discipline strategies; and 1-15 (B) training in cardiopulmonary resuscitation 1-16 and first aid; and 1-17 (2) may include instruction as to what is permissible 1-18 under law, including opinions of the United States Supreme Court, 1-19 in regard to prayers in public school. 1-20 SECTION 2. Subchapter D, Chapter 33, Education Code, is 1-21 amended by adding Section 33.086 to read as follows: 1-22 Sec. 33.086. CERTIFICATION IN CARDIOPULMONARY RESUSCITATION 1-23 AND FIRST AID. (a) A school district employee who serves as the 1-24 head coach or chief sponsor for an extracurricular athletic 2-1 activity, including cheerleading, sponsored or sanctioned by a 2-2 school district or the University Interscholastic League must 2-3 maintain and submit to the district proof of current certification 2-4 in cardiopulmonary resuscitation and first aid issued by the 2-5 American Red Cross, the American Heart Association, or another 2-6 organization that provides equivalent training and certification. 2-7 (b) Each school district shall adopt procedures necessary 2-8 for administering this section, including procedures for the time 2-9 and manner in which proof of current certification must be 2-10 submitted. 2-11 SECTION 3. (a) Section 21.451(a), Education Code, as 2-12 amended by this Act, applies beginning with the 1999-2000 school 2-13 year. 2-14 (b) Section 33.086, Education Code, as added by this Act, 2-15 applies beginning January 1, 2000. 2-16 SECTION 4. The importance of this legislation and the 2-17 crowded condition of the calendars in both houses create an 2-18 emergency and an imperative public necessity that the 2-19 constitutional rule requiring bills to be read on three several 2-20 days in each house be suspended, and this rule is hereby suspended, 2-21 and that this Act take effect and be in force from and after its 2-22 passage, and it is so enacted.
