                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the use of proceeds from a commissary at a county jail.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 351.0415(c), Local Government Code, is
 1-5     amended to read as follows:
 1-6           (c)  The sheriff may use commissary proceeds only to:
 1-7                 (1)  fund, staff, and equip a program addressing the
 1-8     social needs of the county prisoners, including an educational or
 1-9     recreational  program and religious or rehabilitative counseling;
1-10                 (2)  supply county prisoners with clothing, writing
1-11     materials, and hygiene supplies;
1-12                 (3)  establish, staff, and equip the commissary
1-13     operation; [or]
1-14                 (4)  fund, staff, and equip a library for the
1-15     educational use of county prisoners;
1-16                 (5)  purchase a vehicle for use in connection with the
1-17     operation of the county jail; or
1-18                 (6)  expand the county jail by constructing or
1-19     purchasing a building, including a portable building.
1-20           SECTION 2.  This Act applies only to the use of commissary
1-21     proceeds from a commissary operated at a county jail on or after
1-22     the first day of the county's fiscal year that begins on or after
1-23     the effective date of this Act.
1-24           SECTION 3.  The importance of this legislation and the
 2-1     crowded condition of the calendars in both houses create an
 2-2     emergency and an imperative public necessity that the
 2-3     constitutional rule requiring bills to be read on three several
 2-4     days in each house be suspended, and this rule is hereby suspended,
 2-5     and that this Act take effect and be in force from and after its
 2-6     passage, and it is so enacted.
